Who are we?

We are Jumpmind, Inc, and Jumpmind UK Limited. References in this policy to “Jumpmind”, “we”, “us”, and “our” are references to Jumpmind Inc, and Jumpmind UK Limited. This policy gives you information about how your personal data is collected and used where Jumpmind is the controller and responsible for your personal data.

Our website, products, and services are not intended for children and we do not knowingly collect data relating to children.

Where Jumpmind is acting as a processor

Jumpmind may also use your personal data when providing services to its customers in accordance with their instructions. In these circumstances, Jumpmind is acting as a processor for its customer, and our use of your personal data will be in accordance with their privacy policy. This policy does not provide information regarding those activities.

What information do we collect and how do we collect it?

We collect information from you when you register on our site, place an order, fill out a form, or use our software.

When ordering or registering on our site, as appropriate, you may be asked to enter your name, e-mail address, mailing address, or phone number. You may, however, visit our site anonymously.

When using our software, it includes features to check for software updates and send aggregate usage data to us, which includes information about your IP address, time zone, version, statistics of features used, the number of configured objects, and license key number. You may, however, opt to disable those features.

What do we use your information for?

The law requires us to have a lawful basis for collecting and using your personal data. We rely on one or more of the following lawful bases:

  • Performance of a contract with you: Where we need to perform the contract we are about to enter into or have entered into with you.
  • Legitimate interests: We may use your personal data where it is necessary to conduct our business and pursue our legitimate interests, for example to prevent fraud and enable us to give you the best and most secure customer experience. We make sure we consider and balance any potential impact on you and your rights (both positive and negative) before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law).
  • Legal obligation: We may use your personal data where it is necessary for compliance with a legal obligation that we are subject to. We will identify the relevant legal obligation when we rely on this legal basis.
  • Consent: We rely on consent only where we have obtained your active agreement to use your personal data for a specified purpose, for example if you subscribe to an email newsletter.

Any of the information we collect from you may be used in one of the following ways. For each category, we have set out the lawful basis we rely on:

  • To improve customer service. Your information helps us to more effectively respond to your customer service requests and support needs. Lawful bases: i) performance of a contract with you; ii) our legitimate interests.
  • To process transactions. We may process your information in order to manage your customer journey/account, manage payments, deliver your order, and collect or recover money owed to us.. Lawful bases: i) performance of a contract with you; ii) our legitimate interests.
  • To send periodic emails. The email address you provide for order processing may be used to send you information and updates pertaining to your order, in addition to receiving occasional company news, updates, related product or service information, etc. Lawful bases: i) performance of a contract with you; ii) our legitimate interests; iii) necessary to comply with a legal obligation; OR consent, where we have obtained your prior consent to receive direct marketing communications.
  • To improve our products. Your statistical information on product usage provides feedback on where to improve and optimize our software products. Lawful bases: i) our legitimate interests.

Your information, whether public or private, will not be sold, exchanged, transferred, or given to any other company for any reason whatsoever, without your consent, other than for the express purpose of delivering the purchased product or service requested. Opting out of marketing 

You can ask us to stop sending you marketing communications at any time by contacting us using the information on the Contact Us page.

If you opt out of receiving marketing communications, you will still receive service-related communications that are essential for administrative or customer service purposes for example relating to order confirmations for a product/service, updates to our terms and conditions, or checking that your contact details are correct.

How do we protect your information?

We implement a variety of appropriate security measures to maintain the safety of your personal information when you enter, submit, or access your personal information. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

We offer the use of a secure server. All supplied sensitive/credit information is transmitted via Transport Layer Security (TLS) technology and then encrypted into our Payment gateway providers database only to be accessible by those authorized with special access rights to such systems, and are required to keep the information confidential.

After a transaction, your private information (credit card numbers, etc) will not be stored on our servers.

Do we use cookies?

Yes. Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your Web browser (if you allow) that enables the sites or service providers systems to recognize your browser and capture and remember certain information

We use cookies to help us remember and process the items in your shopping cart and compile aggregate data about site traffic and site interaction to offer better site experiences and tools in the future.

Do we disclose any information to outside parties?

We may share your personal data where necessary with trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. 

We may share your personal data with third parties to whom we may choose to sell, transfer or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy policy.

We may also release your information when we are required to in order to comply with the law, or if we need to do so to enforce our site policies, or protect ours or others’ rights, property, or safety. 

We will get your express consent before we share your personal data with any third party for their own direct marketing purposes. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

International transfers

We may share your personal data within the Jumpmind Group. This will involve transferring your data outside the UK to our overseas offices in the USA.

We may transfer your personal data to service providers that carry out certain functions on our behalf. This may involve transferring personal data outside the UK to countries which have laws that do not provide the same level of data protection as the UK law.

Whenever we transfer your personal data out of the UK to countries which have laws that do not provide the same level of data protection as the UK law, we use specific standard contractual terms approved for use in the UK which give the transferred personal data the same protection as it has in the UK. How long will we use your personal data for?

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

In some circumstances we will anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

California Online Privacy Protection Act Compliance

Because we value your privacy we have taken the necessary precautions to be in compliance with the California Online Privacy Protection Act.

As part of the California Online Privacy Protection Act, all users of our site may make any changes to their information at any time by logging into the Support Center and going to the ‘My Account’ page.

Childrens Online Privacy Protection Act Compliance

We are in compliance with the requirements of COPPA (Childrens Online Privacy Protection Act), and we do not collect any information from anyone under 13 years of age. Our website, products, and services are all directed to people who are at least 13 years old or older.

Your legal rights under the UK General Data Protection Regulation

You have the right to access, correct, erase, restrict, request the transfer of, and object to the processing of, the personal data we collect. You also have an absolute right to object to the processing of your personal data for direct marketing purposes.

You have the right to withdraw consent at any time where we are relying on consent as the lawful basis to process your personal data (see the sections above for details of when we rely on your consent as the lawful basis for using your data). However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent

To exercise your rights to your data, either login to Support Center or Contact Us with your subject access request, and we will fulfill it within 30 days.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
